Our clients — mom, dad, and son — were driving eastbound on I-88 on a Sunday afternoon headed towards downtown Chicago as traffic slowed to a stop for construction-related traffic. Meanwhile, a truck driver for MCT Transportation was also traveling eastbound on I-88 in his company’s loaded tractor-trailer. The evidence suggested that the driver was distracted by using his cell phone to create a music playlist, failed to slow his tractor-trailer for stopped traffic, and crashed into the rear of the Montes’ vehicle at high speed.

Mom and dad fortunately suffered only modest physical injuries in the crash. However, their son — who was seated in the back seat at the time of the crash — suffered a devastating traumatic brain injury requiring emergent brain surgery, specifically a craniectomy and evacuation of acute subdural hematoma and frontal and anterior lobectomy. He also required subsequent plastic surgeries for facial fractures and cranial defects.
