Matthew Passen Examines Whether Settling Defendants Should Appear on a Jury Verdict Form in Illinois.
In an article published in the February/March 2009 edition of the Chicago Bar Association’s “CBA Record” publication, Mr. Passen examines an issue previously undecided by the Illinois Supreme Court. Specifically, Mr. Passen examines whether a defendant who has already settled with the plaintiff prior to trial should nevertheless be listed on the jury verdict form for purposes of apportioning fault among all defendants, including settling defendants. Mr. Passen notes that the Illinois courts are split on the issue, and the Illinois Supreme Court is expected to resolve the issue in Ready v. United/Goedecke Services, Inc.
