When this case was referred to Passen & Powell from another law firm, there were serious questions about the nature of back injuries to our client, a woman with longstanding degenerative scoliosis of her spine, in the subsequent motor vehicle crash in which she was rear-ended by a negligent driver. Our attorneys went to work investigating investigating the nature of the crash — including the G forces involved — as well as the nature of our client’s pre-existing condition and her subsequent tretment and ultimate surgery with an orthopedic spine surgeon. After interviewing several witnesses and developing the issues of liabilitly, proximate cause and damages with our client’s family, friends, co-workers and treating physicians, we were able to convince the negligent driver’s insurance company that there was a realistic probability of a favorable jury verdict at trial in excess of its insurance policy limits of $1 million. The case settled for $1 million — an excellent result especially given our client’s significant pre-existing spine condition.
